UK has Voted to Leave the EU. What Now?

Possible Brexit Vote Outcomes

In a nutshell, the referendum decision will not result in any immediate changes, at least not until October of this year. Parliament must pass it through the proper legislative process to amend or repeal UK law. As our previous Brexit post indicated, the United Kingdom must notify the European Union of its decision to depart by invoking post 50 of the Treaty of the European Union. This will start a renegotiation period with the EU over the leave terms.

David Cameron, who will quit as Prime Minister at the Conservative Party conference in October, stated that no Article 50 notification will be issued until the next leader is elected in October of this year. As a result, the UK will remain a member of the EU. During the negotiation process, it will continue to comply with EU treaties and legislation until October 2016 and, subsequently, if Article 50 is invoked.

ILR is a critical step toward assimilating into British society and enjoying the rights and benefits of permanent residency. It allows persons to live, work, and study in the United Kingdom without regard to time constraints. However, it is critical to keep the ILR status by following immigration regulations, as any protracted absence from the UK or involvement in illegal activities can jeopardize the ILR status.

How will this affect EU citizens?

EU nationals who have verified their right to Permanent Residence by completing a suitable application will be unaffected by the UK’s decision. In the case of all other EU nationals, some agreement will be implemented to secure their status. Over 3 million EU nationals in the UK have never applied to confirm their status because it is not required by EU legislation.

The UK may also choose to implement “transitional arrangements” for EU individuals who are currently residents in the UK, meaning that they may theoretically continue to remain here without difficulty while imposing harsher immigration rules on new arrivals.

Individuals who have had ILR for a set period, often five years, may be entitled to apply for British citizenship, further cementing their links to the UK. Individuals with British citizenship have the right to a British passport, unfettered access to employment possibilities, and the capacity to engage in the country’s political and social life fully.
